Elizabeth Cook, 41 was driving her 1995 Chevrolet pickup truck on Roscoe Ave. in Chatsworth on Nov. 13, 1998. Her daughter, then two, was a passenger in the truck. Their truck was struck by a 1992 For Ranger driven by Tyler Wolbert as the two waited to make a left hand turn at the intersection of Roscoe and Winnetka Ave. Wolbert had run the red light, and was arrested and convicted of driving under the influence after the accident. The truck he was driving was registered to Stephen Hennessy. Elizabeth, Nicole and Weldon Cook sued Wolbert and Hennessy, alleging vehicular negligence and negligent entrustment. Weldon subsequently dismissed his loss of consortium claim and Nichole settled her claim at a mediation that occurred on Nov. 2, 2001. The parties stipulated to liability.
Elizabeth Cook claimed that she suffered acute cervical decompression fracture, acute cervical, thoracic and lumber disc bulges with thecal sac compromise, bilateral upper and lower extremity radiculopathy, left ulnar neuropathy/compression, acute left knee internal derangement, cerebral concussion, acute right shoulder rotator cuff tear, possible partial seizure and vertigo. She underwent surgery for her right knee and right shoulder injuries. She complained residual of headaches, dizziness, vertigo, shoulder pain, knee pain, and neck pain. The defense claimed that Elizabeth had a pre-existing knee injury and that all of her injuries were merely soft tissue varieties.
