Los Angeles, CA July 18, 2002 – Wrongful death and personal injury attorney, Michael H. Silvers, A Law Corporation, a law firm specializing in Multi-vehicle and wrongful death accidents, announced a $1.5 million settlement for wrongful death resulting from a multi-vehicle accident.
On Feb25, 1998, the decedent was injured in a multiple-car accident. The plaintiffs contended that the defendants were solely responsible for the accident. The decedent suffered a severe back injury which eventually required an L45 fusion and placement of a bone growth stimulator. The stimulator was eventually removed and the decedent underwent revision surgery for removal of the hardware and revision of the fusion. The decedent died three days later from a pulmonary embolism.
The defendant contended that the decedent recovered from back injury, and that he had significant degeneration in his back since 1978. The defendant claimed that the decedent had been a heavy smoker and would not have needed the final surgery if he had stopped smoking. Additionally, the decedent was also an insulin-dependant diabetic, had hypertension and an adenocarcinoma in his left lung which had enlarged since January, 2000 meaning that the decedent would not have worked for more than one or two more years after the date of the accident.
Settlement discussions: The plaintiffs, the decedent’s surviving wife and 7-year old daughter made a $2 million policy limits demand shortly before the mediation.
