En route to El Paso, Texas July 18, 2004 – Los Angeles Personal Injury Attorney, Michael H. Silvers, a law firm specializing in car accident personal injury cases, announced a $60,000 settlement for a passenger riding in a bus, injured by risking his own safety to help the bus driver. 

The incident involved a simple bus ride turned into a painful nightmare.  Boarding a bus in Los Angeles with his wife and children, the plaintiff looked forward to a peaceful vacation.  Not long after departure, however, the bus broke down and pulled over on the side of the highway.  Because of the heat, the bus driver opened the emergency roof hatches and in his haste failed to close them before restarting the bus. 

Because of the potential danger, the bus driver asked the plaintiff to reach up and close the emergency hatch.  Concerned for his family’s safety and the welfare of the other passengers, the plaintiff reached up to secure the hatch.  Unfortunately, the hatch crashed down on the plaintiff’s left arm and right index finger causing severe damage.  Bleeding profusely with his children and wife in distress, the plaintiff asked the bus driver for assistance only to be met with indifference and no first aid kit available on the bus. 

Finally, the bus driver pulled over where an ambulance transported the plaintiff to the hospital.  He received 59 stitches, suffered an infection in his arm, lost 10 days of work, and had to postpone his home renovation project which resulted in a loss of time and money.  And after consulting with a plastic surgeon, the plaintiff was faced with the harsh reality that his scars were permanent.  To this day, the plaintiff wears long sleeve shirts to cover the scars.

Despite the negligent behavior of the bus driver, the bus company’s insurance carrier refused full responsibility for the plaintiff’s extensive injuries and trauma.  In fact, the carrier claimed that the plaintiff’s efforts to help the bus driver made him 50% responsible for his own injuries, and therefore, the insurance company would not fully compensate him.  However, after bringing attorney Michael H.
